A charge against New Hampshire Insurance Company has just been made. The lawsuit was filed by the Atlanta Hawks Basketball and Entertainment LLC for breach of contract in the settlement of Danny Ferry’s claims. He was the former general manager for the NBA franchise under the former ownership group (AHBE) that comprised of Bruce Levenson as the controlling partner. The lawsuit filed does not involve Forbes billionaire Tony Ressler’s group that currently owns the Hawks.
The civil action lawsuit filed in the Superior Court of Fulton County was against AIG. The action for insurance bad faith and breach of contract was made on September 13. In the Claim, AHBE notes that it was insured under a policy covering several losses related to employment practices. The practices include certain acts of wrongful termination along with workplace torts. Additionally, the practices are not limited to the two acts. According to the court documents, AIG was given notice by AHBE on April 2, 2015 that it believed the claims made by Ferry were covered.
Prior to the approval to sale the NBA franchise to Ressler’s group, Ferry and the Hawks ownership had reached an agreement two days earlier on June 22,2015.
According to the current ownership spokesperson, they are aware of the lawsuit. The spokesperson noted that since the parties involved no longer have ties with the organization, there will be no further discussion on the matter. According to court documents, the claim’s amount is confidential. The charge states that AIG has refused to recognize that a claim was made as well as the policy has been triggered. Additionally, it states that AIG has failed to accept coverage or participate in the said claims’ defense.
